Ministry of Energy of the Russian Federation (Ministry of Energy of Russia) - the federal executive body of Russia that carries out public administration in the field of energy and administered by the Government of the Russian Federation.

Story

In 1991, after the collapse of the USSR, state energy enterprises were privatized and became private property. The Union Ministry was liquidated, the republican one was transformed into Ministry of Fuel and Energy of the Russian Federation, later transformed into the "Ministry of Industry and Energy of the Russian Federation" (until May 12, 2008). After the privatization of state-owned enterprises, ministries perform the functions of advice, monitoring, control and supervision.

Ministry of Energy of Russia (2008)

Established on May 12, 2008 by Decree of the President of the Russian Federation No. 724 through the division of the Ministry of Industry and Energy of the Russian Federation. The Ministry of Energy of the Russian Federation is developing and implementing public policy in the industry and legal regulation of the fuel and energy complex, including on issues of electric power, oil production and oil refining industries, gas, peat, coal and shale industries, their processed products, renewable energy sources, development of hydrocarbon deposits on the basis of production sharing agreements and in the petrochemical industry, as well as law enforcement functions and functions for the provision of public services, for the management of state property in the production and use of fuel and energy resources.

The Ministry of Energy of the Russian Federation is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, as well as the Regulations on the Ministry of Energy of the Russian Federation.

1. The Ministry of Fuel and Energy of the Russian Federation (Ministry of Fuel and Energy of Russia) is the central body of the federal executive power, managing the functioning and development of the fuel and energy complex of the Russian Federation, as well as coordinating the activities of independent enterprises and organizations of the electric power industry, oil production, oil refining, gas, coal, shale and peat industry, gasification and gas supply to the gas industry, petroleum product supply systems and main oil, gas and petroleum product pipelines, specialized engineering, construction, scientific, design and other enterprises and organizations (hereinafter referred to as enterprises of the fuel and energy complex) on issues related to its management

2. The Ministry of Fuel and Energy of Russia in its activities is guided by the Constitution of the Russian Federation, the Law of the Russian Federation "On the Council of Ministers - the Government of the Russian Federation" and other legislative acts of the Russian Federation, decrees and orders of the President of the Russian Federation, resolutions and orders of the Council of Ministers - the Government of the Russian Federation, as well as by this Regulation.

3. The Ministry of Fuel and Energy of Russia carries out its activities in cooperation with other central bodies of the federal executive power.

4. The Ministry of Fuel and Energy of Russia carries out its work on the principles of close interaction with the executive authorities of the republics within the Russian Federation, territories, regions, autonomous entities, the cities of Moscow and St. Petersburg in order to coordinate and take into account the interests of the fuel and energy industries and regions, assists these bodies in the structural restructuring of the fuel and energy complex, the creation of new jobs, the development of production and social infrastructure.

5. The main tasks of the Russian Ministry of Fuel and Energy are:

development and implementation, in accordance with current legislation, of state policy in the fuel and energy complex of the Russian Federation;

meeting the needs of the national economy and population in various types energy, its rational and safe (environmentally and technologically) use and conservation in all areas of consumption;

ensuring efficient and sustainable functioning of the fuel and energy complex;

organizing the development of the main directions for the development of the fuel and energy complex;

participation in the development and implementation of state policy for the formation of market relations based on the development of a competitive environment, changes in property relations in the fuel and energy complex, and the implementation of industry demonopolization programs;

expanding the participation of the fuel and energy complex in solving macroeconomic problems of Russia, integrating its economy into the global economic space, increasing the efficiency of export of fuel and energy resources, promoting the attraction of foreign investment in the development of the complex, encouraging investment activities abroad of enterprises of the fuel and energy complex, using in the interests of national economic opportunities for international fuel and energy organizations;

implementation of state regulation of the activities of enterprises of the fuel and energy complex by organizing the development and approval, in accordance with the current legislation, of normative and technical acts, standards, norms and rules in the field of organizing the operation, repair and construction of enterprises of the complex and monitoring their compliance;

decision in agreement with the authorities state power and management of the constituent entities of the Russian Federation, bodies local government issues of location and construction of large enterprises of the fuel and energy complex.

6. The main functions of the Ministry of Fuel and Energy of Russia are:

development of proposals for the formation and participation in organizing the implementation of industry demonopolization programs, state targeted scientific and technical programs for the creation of new energy technologies and equipment, solving energy saving problems, introducing highly efficient, environmentally friendly and reliable technological processes, including through the conversion of defense and machine-building complexes;

development and implementation of state policy in the field of design and construction of enterprises in the fuel and energy complex;

ensuring state energy supervision, state control and supervision over the rational use of oil, gas and their products, the quality of peat in all spheres of the economy of the Russian Federation, as well as state supervision over the objects of the fuel and energy complex in terms of ensuring the safety of navigation, underwater technical work , operation of hydraulic structures and prevention of pollution of the aquatic environment with oil;

ensuring measures to comply with the requirements for the protection of subsoil and other natural resources when enterprises carry out a range of economic activities;

agreement, in accordance with the current licensing regulations, of the procedure, terms and conditions for involving in the development of existing and newly identified oil, gas and coal deposits;

participation in establishing the main technical and economic indicators of oil, gas and coal production for the submission of licenses and in monitoring the implementation of the stipulated conditions for the development of fields under existing licenses, as well as the examination of calculations justifying the amount of recoverable reserves of oil, gas and coal;

ensuring organizational, technical and economic conditions for increasing the environmental and technological safety of existing enterprises and compliance with environmental and operational standards of newly commissioned and reconstructed enterprises;

development of proposals for demonopolization, socio-economic development, effective implementation of price, investment, tax, concession policies, implementation of achievements of scientific and technological progress that ensure reliability, sustainability, efficiency and safety of the enterprises of the fuel and energy complex; credit and financial regulation of the functioning and development of the complex;

development of proposals for legislative and regulatory acts regulating the activities of the fuel and energy complex, participation together with interested organizations in the coordination, implementation and monitoring of the implementation of legislative and regulatory acts on issues of the fuel and energy complex;

participation in improving the economic mechanism for regulating the work of enterprises in the fuel and energy complex in the context of the transition to market relations; preparation, together with interested organizations, of proposals for the creation and regulation of economic and legal foundations for the development of market relations, direct commercial relations aimed at sustainable provision of the national economy and population of the Russian Federation with fuel and energy, as well as reliable material and technical supply of enterprises of the complex;

development of proposals for the formation of tariffs, prices, subsidies for fuel and energy resources and other products of the complex industries;

organization and coordination of fulfillment of obligations under interstate agreements of the Russian Federation relating to issues of the complex’s activities;

assistance in attracting foreign investors in the prescribed manner for the development of industries of the complex and increasing their export potential; providing assistance to enterprises of the complex in the implementation of foreign projects;

participation in the development and implementation, jointly with the Ministry of Foreign Affairs of the Russian Federation, the Ministry of Foreign Economic Relations of the Russian Federation and other central bodies of the federal executive power, of state policy in the field of export-import operations;

creation in the prescribed manner of off-budget industry funds to finance capital construction, research and development work, insurance and others;

creation, in accordance with current legislation, of a currency fund for the purchase of equipment and materials for general industry purposes;

preparation and organization of the implementation of proposals for establishing quotas for export-import operations on the range of products of the fuel and energy complex, participation in the formation and distribution of quotas for the transfer from Russia of oil, gas, coal and their processed products and electricity, bringing quotas to producers of these products in accordance with an established order;

interaction with enterprises of the fuel and energy complex in order to create conditions for the safe operation of production, working conditions in the sectors of the complex, the introduction of new means and methods for the prevention of occupational diseases, industrial injuries and accidents, development and approval, in agreement with the relevant bodies (including trade unions), of industry rules and norms and monitoring their compliance;

organization, coordination and control together with the State Committee of the Russian Federation for Affairs civil defense, emergency situations and liquidation of consequences of natural disasters, implementation of measures aimed at preventing and eliminating the consequences of emergency situations in the system of the fuel and energy complex of Russia, introduction of mobilization training, implementation of civil defense measures; ensuring reliable protection of state secrets, other classified information and special communications, providing methodological guidance to these areas of work on the basis of uniform national legislative and regulatory acts;

providing methodological guidance to the activities of geological and surveying services of mining enterprises;

implementation through the industry control system of measures to ensure the safety of work and the protection of subsoil, the implementation of relevant acts of legislation at the enterprises of the complex;

creation, provision of technical guidance and control over the activities of mountain rescue units and detachments, as well as paramilitary security units included in the fuel and energy complex system, and approval in the prescribed manner of their locations;

coordination of the work of departmental and professional emergency rescue units included in the Russian system of warning and action in emergency situations, during emergency rescue and other urgent work;

management of the creation, ensuring readiness and functioning of the departmental subsystem of the Russian system of warning and action in emergency situations in accordance with the functions assigned to the Ministry of Fuel and Energy by the Council of Ministers - the Government of the Russian Federation;

participation in the implementation of a unified state policy in the field of personnel formation, employment, social protection of workers, pensions, development of labor relations based on social partnership, prevention and resolution of labor conflicts, youth and migration policy;

organization of training, retraining and advanced training of personnel for enterprises of the fuel and energy complex; implementation, within the limits of competence and authority established by law, of the management of the sectoral system of educational institutions;

Providing methodological assistance to enterprises of the fuel and energy complex in the implementation of state social insurance and compulsory insurance against industrial accidents and occupational diseases, organizing a complex of medical and preventive care at enterprises, participating in the preparation of proposals for improving preferential pension provision;

assistance in the development and regulation of inter-republican, regional economic relations of enterprises of the complex with consumers of the complex’s products and suppliers of material and technical resources on the basis of business partnership and economic interest;

performing the functions of a general supplier in relation to assigned facilities being built abroad with the technical assistance of the Russian Federation;

carrying out an analysis of the production and economic activities of enterprises in the fuel and energy complex, ensuring constant information flows for the implementation of state regulation in the prescribed manner;

development of proposals to stimulate increased productivity and labor efficiency, a social protection mechanism and recommendations for organizing wages for employees of fuel and energy complex enterprises, participation in the development, conclusion and implementation of industry (tariff) agreements in accordance with current legislation;

organization of fire prevention work aimed at ensuring reliable and trouble-free operation of enterprises in the fuel and energy complex;

7. The Ministry of Fuel and Energy of Russia to perform the tasks and functions assigned to it:

forms a unified strategy for scientific, technical, production, technical and socio-economic development of the fuel and energy complex;

develops, with the involvement of other ministries, departments and industry enterprises (joint stock companies), a strategy for the development and use of hydrocarbon resources, the fuel and energy balance of the Russian Federation by type of fuel and specific consumers, organizes and coordinates the actions of industry enterprises (joint stock companies) aimed at ensuring reliable and sustainable supply of the national economy and population with fuel, thermal and electrical energy, concludes, on behalf of the Council of Ministers-Government of the Russian Federation, production contracts with enterprises of the complex;

develops, together with other interested federal executive bodies, the main directions of state policy in the field of energy saving, coordinates the most important work to improve the efficiency of energy use in the national economy and takes part in the preparation of proposals for their financing (paragraph additionally included by the Decree of the Government of the Russian Federation of November 2, 1995 N 1087);

makes proposals to the Council of Ministers - the Government of the Russian Federation with the involvement of other ministries and departments for implementation government programs in the field of fuel and energy supply: on financial, credit and economic issues, including a draft budget request to finance the activities of the fuel and energy complex, on the development of measures to stimulate increased productivity and labor efficiency, on the mechanism of social protection, on the organization of remuneration of workers enterprises of the fuel and energy complex, on the regulation of labor relations in the sectors of the complex and other issues of the activities of the fuel and energy complex in accordance with current legislation;

creates an information bank of the fuel and energy complex of the Russian Federation based on information received from enterprises of the complex, and submits information to the federal economic authorities based on established statistical reporting;

creates and develops means and systems of production and technical and information communication branches of the fuel and energy complex;

acts on behalf of the Council of Ministers-Government of the Russian Federation as a customer when placing orders in the prescribed manner for the supply of products, production of works (services) for government needs at enterprises of the complex and providing these enterprises with the necessary resources jointly with the Ministry of Economy of the Russian Federation, the Ministry of Finance of the Russian Federation and other interested organizations;

concludes contracts with the heads of federally owned state-owned enterprises and approves the charters of such enterprises when these functions are delegated to the Ministry of Fuel and Energy of Russia by the State Committee of the Russian Federation for State Property Management;

gives, on behalf of the State Committee of the Russian Federation for State Property Management, conclusions on draft decisions on the creation, reorganization and liquidation of federally owned fuel and energy complex facilities, and also develops proposals for recommendations to take into account the characteristics of industry enterprises taken into account during privatization and the exercise of powers owner;

participates in the examination of projects and estimates for the construction of large, inter-industry enterprises of the fuel and energy complex, as well as the most significant scientific and technical developments for the implementation of the tasks facing the complex;

submits to the State Committee of the Russian Federation for State Property Management, the Russian Federal Property Fund, committees for property management and the property fund of national-state, national-territorial and administrative-territorial entities to attract them in the prescribed manner to exercise the powers of the state as the owner of enterprises ( shares in the authorized capital) as representatives of these bodies;

determines, together with industry enterprises (joint stock companies), the procedure for managing energy product pipeline systems and the federal energy system;

receives from the State Committee of the Russian Federation on Statistics and enterprises of the fuel and energy complex statistical data on issues within the competence of the Ministry of Fuel and Energy of Russia;

assigns industry honorary titles to the best workers, and also rewards, in the prescribed manner, leading workers in the sectors of the complex with appropriate badges and certificates of honor;

convenes conferences and meetings in accordance with the established procedure, organizes exhibitions on the problems of improving and developing the activities of the sectors of the complex.

8. The Ministry of Fuel and Energy of Russia is headed by a Minister appointed by the President of the Russian Federation.

The Minister has deputies appointed by the Council of Ministers of the Government of the Russian Federation. The distribution of responsibilities between the Deputy Ministers is made by the Minister.

9. Minister of Fuel and Energy of the Russian Federation:

manages the activities of the Ministry on the basis of unity of command;

bears personal responsibility for the implementation of the tasks and functions assigned to the Ministry, establishes the degree of responsibility of Deputy Ministers and members of the board, heads of structural divisions of the Ministry;

within the limits of its competence, issues orders, instructions and gives instructions that are mandatory for execution by divisions of the central apparatus, as well as enterprises of the fuel and energy complex;

10. The Ministry of Fuel and Energy of Russia forms a board consisting of the Minister (chairman of the board), his deputies, heads of leading departments of the Ministry and enterprises, approved by the Council of Ministers - the Government of the Russian Federation.

The Ministry of Fuel and Energy of Russia, at regularly held board meetings, considers issues of the activities and functioning of the fuel and energy complex. The decisions of the board are implemented by orders of the Ministry.

11. A scientific, technical and economic council with sections on individual problems is being formed in the Ministry of Fuel and Energy of Russia. The personal composition of the scientific, technical and economic council and its regulations are approved by the Minister of Fuel and Energy of the Russian Federation. Organizational and technical support for the work of the council is carried out by the central apparatus of the Ministry.

12. The Ministry of Fuel and Energy of the Russian Federation is legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, current and other accounts in banking institutions.

13. Expenses for the maintenance of the central apparatus of the Ministry of Fuel and Energy of Russia are financed from the funds of the republican budget of the Russian Federation, allocated for the maintenance of the central bodies of the federal executive power of the Russian Federation.

In accordance with Decree of the President of the Russian Federation dated May 12, 2008 N 724 “Issues of the system and structure of federal executive bodies”, the Government of the Russian Federation decides:

2. Allow the Ministry of Energy of the Russian Federation to have 8 Deputy Ministers, including one First Deputy Minister and one Secretary of State - Deputy Minister, as well as in the structure of the central apparatus up to 15 departments in the main areas of activity.

5. The Ministry of Energy of the Russian Federation shall submit to the Government of the Russian Federation, in the prescribed manner, proposals to bring acts of the Government of the Russian Federation into conformity with Decree of the President of the Russian Federation of May 12, 2008 N 724 “Issues of the system and structure of federal executive bodies” and this resolution.

6. The Ministry of Economic Development of the Russian Federation, together with the Ministry of Energy of the Russian Federation, shall submit an agreed proposal on the location of the Ministry of Energy of the Russian Federation in Moscow.

7. Establish that until the Government of the Russian Federation approves the list of subordinate organizations of federal executive authorities, the Ministry of Energy of the Russian Federation will have jurisdiction over organizations that were under the jurisdiction of the Federal Energy Agency.

The Ministry of Energy of the Russian Federation, within 2 months, submits to the Government of the Russian Federation, in accordance with the established procedure, proposals to assign to the Ministry of Energy of the Russian Federation organizations that were under the jurisdiction of the Ministry of Industry and Energy of the Russian Federation.

8. Establish that, before the adoption of the relevant regulatory act, the Ministry of Energy of the Russian Federation approves quarterly schedules for the transportation of oil through the main oil pipeline system, taking into account the supply of oil, petroleum products and liquefied hydrocarbon gases to the domestic market.

I. General provisions

1. The Ministry of Energy of the Russian Federation (Ministry of Energy of Russia) is a federal executive body that carries out the functions of developing and implementing state policy and legal regulation in the field of the fuel and energy complex, including on issues of electric power, oil production, oil refining, gas, coal , shale and peat industries, main pipelines of oil, gas and their products, renewable energy sources, development of hydrocarbon deposits on the basis of production sharing agreements, and in the petrochemical industry, as well as functions for the provision of public services, management of state property in the production sector and use of fuel and energy resources.

The Ministry of Energy of the Russian Federation is a federal executive body that carries out the functions of developing state policy and legal regulation in the field of energy saving and increasing energy efficiency on issues of information support for measures to save energy and increasing energy efficiency, accounting for energy resources used.

The Ministry of Energy of the Russian Federation is a federal executive body that implements state policy and legal regulation in the field of heat supply in terms of the production of thermal energy in the mode of combined generation of electrical and thermal energy, as well as the transfer of thermal energy produced in the mode of combined generation of electric and thermal energy energy, including that produced by thermal energy sources if such thermal energy sources are included in a heat supply scheme that includes sources of combined generation of electrical and thermal energy.

The Ministry of Energy of the Russian Federation, within its competence, carries out the functions of creating, operating and improving the state information system of the fuel and energy complex.

2. The Ministry of Energy of the Russian Federation is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, as well as these Regulations.

3. The Ministry of Energy of the Russian Federation carries out its activities directly and through its subordinate organizations in interaction with other federal executive authorities, executive authorities of the constituent entities of the Russian Federation, local government bodies, public associations and other organizations.

II. Authority

4. The Ministry of Energy of the Russian Federation exercises the following powers:

4.1. submits to the Government of the Russian Federation draft federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation and other documents that require a decision from the Government of the Russian Federation on issues related to the established scope of activity of the Ministry, as well as a draft work plan and forecast performance indicators Ministries;

4.14. organizes and ensures mobilization preparation and mobilization of the Ministry, and also monitors the activities of organizations under its jurisdiction for their mobilization preparation and mobilization;

4.15. organizes additional professional education for Ministry employees;

4.16. interacts in the prescribed manner with government authorities of foreign states and international organizations in the established field of activity;

4.17. carries out, in accordance with the legislation of the Russian Federation, work on the acquisition, storage, recording and use of archival documents generated in the course of the activities of the Ministry;

By Decree of the Government of the Russian Federation of October 13, 2008 N 753, the Regulations were supplemented with subclause 4.17.1

4.17.1. develops and implements measures to support small and medium-sized businesses aimed at their development, including the development and implementation of relevant departmental target programs in the established field of activity;

4.18. performs other functions in the established field of activity, if such functions are provided for by federal laws, regulatory legal acts of the President of the Russian Federation or the Government of the Russian Federation.

5. The Ministry of Energy of the Russian Federation, in order to exercise powers in the established field of activity, has the right:

5.1. request and receive, in the prescribed manner, information necessary for making decisions on issues within the competence of the Ministry;

5.2. establish, in the manner established by the regulatory legal acts of the Russian Federation, a departmental insignia giving the right to confer the title “Veteran of Labor” and other departmental awards and award them to employees of the Ministry, subordinate organizations, as well as other persons operating in the established field, approve provisions on these badges and awards, as well as their descriptions;

5.5. establish, in accordance with the established procedure, print media for the publication of normative legal acts in the established field of activity, official announcements, and placement of other materials on issues within the competence of the Ministry.

6. When implementing legal regulation in the established field of activity, the Ministry of Energy of the Russian Federation does not have the right to establish functions and powers of federal government bodies, government bodies of constituent entities of the Russian Federation, bodies local self-government, and also does not have the right to establish restrictions on the exercise of the rights and freedoms of citizens, the rights of non-state commercial and non-profit organizations, except in cases where the possibility of introducing such restrictions by acts of authorized federal executive bodies is expressly provided for by the Constitution of the Russian Federation, federal constitutional laws, federal laws and issued on the basis of and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws by acts of the President of the Russian Federation and the Government of the Russian Federation.

III. Organization of activities

7. The Ministry of Energy of the Russian Federation is headed by a Minister, appointed and dismissed by the President of the Russian Federation on the proposal of the Chairman of the Government of the Russian Federation.

The Minister bears personal responsibility for the implementation of the powers assigned to the Ministry of Energy of the Russian Federation and the implementation of state policy in the established field of activity.

9. Minister:

9.2. approves regulations on the structural divisions of the Ministry;

9.3. in accordance with the established procedure, appoints and dismisses employees of the Ministry;

9.4. resolves, in accordance with the legislation of the Russian Federation on the state civil service, issues related to the performance of the federal state civil service in the Ministry;

9.5. approves the structure and staffing of the Ministry within the limits of the wage fund and the number of employees established by the Government of the Russian Federation, the cost estimate for its maintenance within the limits of the appropriations approved for the corresponding period provided for in the federal budget;

9.6. submits to the Government of the Russian Federation draft regulatory legal acts and other documents specified in subclause 4.1 of these Regulations;

9.7. submits to the Government of the Russian Federation in the prescribed manner proposals for the creation, reorganization and liquidation of organizations subordinate to the Ministry;

9.9. represents, in the prescribed manner, employees of the Ministry and other persons carrying out activities in the established field, for the conferment of honorary titles and state awards of the Russian Federation, the Certificate of Honor of the President of the Russian Federation, for encouragement in the form of a declaration of gratitude to them from the President of the Russian Federation;

9.10. issues orders of a normative nature, and on operational and other current issues of organizing the activities of the Ministry - orders of a non-normative nature.

10. Financing of expenses for the maintenance of the Ministry of Energy of the Russian Federation is carried out from funds provided in the federal budget.

11. The Ministry of Energy of the Russian Federation is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, other seals, stamps and forms of the established form, accounts opened in accordance with the legislation of the Russian Federation.

The Ministry of Energy of the Russian Federation has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry in agreement with the Heraldic Council under the President of the Russian Federation.

12. The location of the Ministry of Energy of the Russian Federation is Moscow.
